Article 1 — General Provisions These Terms of Service ("Terms") set forth the conditions of use for the online store ("Service") operated by SENSO del MARE ("we," "us," or "our"). By using the Service, customers ("you") are deemed to have agreed to these Terms and our separately established Privacy Policy. Matters not covered by these Terms shall be governed by the applicable laws of Japan.

Article 2 — Service Content The Service primarily consists of the sale of products offered by us and the provision of related information. We may change, add to, or discontinue the content of the Service without prior notice to you.

Article 3 — Prohibited Activities In using the Service, you must not engage in any of the following:

  1. Acts that violate laws, regulations, or public order and morals
  2. Acts that infringe upon the intellectual property rights (copyright, trademark, patent, etc.), privacy rights, reputation, or any other rights of us or third parties
  3. Fraudulent, threatening, defamatory, harassing, or other illegal acts
  4. Unauthorized access to, tampering with, interception of data from, or distribution of viruses to our systems or security infrastructure, or similar acts
  5. Purchasing products for the purpose of resale or other commercial gain (unless separately authorized by us)
  6. Reproducing, republishing, or quoting Service content without our permission
  7. Interfering with our business operations or providing information to competitors
  8. Using unauthorized discount codes
  9. Defaming us or third parties
  10. Any other acts we deem inappropriate

Article 4 — Product Purchases

  1. A purchase request is established when you select a product on the Service and submit an order.
  2. A sales contract is formed when we send an order confirmation email and you receive it.

Article 5 — Payment When paying by credit card, you are responsible for the proper management and use of your card. We bear no responsibility for verifying whether credit card information has been used legitimately. For other payment methods, the terms of service of the respective payment provider shall apply.

Article 6 — Shipping

  1. Products are shipped via Yamato Transport or Japan Post within JAPAN.
  2. 【SHIPPING to OVERSEAS】
    Fragrances cannot be shipped internationally.
    Clothing items are available for international shipping, and in such cases, we use Japan Post EMS.
  3. Delivery is limited to the address specified by you.
  4. If a product is returned to us due to extended absence or an incorrect delivery address causing the carrier's storage period to expire, the item will be re-shipped. Additional shipping costs for re-shipment are borne by you (cash on delivery). Please note that order cancellations cannot be accepted in such cases.
  5. Ownership of the product transfers to you at the time we hand the product over to the carrier.
  6. For shipments to the United States only, duties are prepaid under DDP (Delivered Duty Paid).
  7. To other countries the terms of sales are DDU " duties and taxes unpaid". The price shown does not include such items as VAT, import duty, tax and other unpredictable charges against middleman and agents. In case of these unexpected charge needed in the due course, these charges should be paid by the customers. For more information regarding your country's custom policies, please contact your local customs office or its agents.

    Merchandise will be shipped through EMS by the Japan Post Office. However, they can be shipped differently as required by the destination countries. Under the ordinary condition, international shipping will take approximately from two weeks to maximum of four weeks depending on the destinations. Shipment’s tracking service is provided by Japan Post office. We will send “tracking number” to customers.

Article 7 — Returns, Exchanges, and Refunds

  1. Returns and exchanges are accepted only in the following cases:
    • Damage during shipping
    • Product defects
    • Delivery of a product different from what was ordered
  2. Please contact us via the inquiry form within 30 days of receiving the product.
  3. Cancellations, returns, or exchanges due to customer convenience (e.g., ordering errors) are not accepted in principle, except in cases of product defects.
  4. If you wish to return a product, please contact us in advance and return the product in accordance with our instructions.
  5. Return shipping costs for defective, damaged, or incorrectly shipped items are borne by us.
  6. Upon receipt and inspection of the returned product, we will promptly issue a refund. Refunds cover the product price only; for orders where a discount code was applied, the refund is based on the actual amount paid after the discount.

Article 7-A — Right of Withdrawal (EU Consumers Only) If you are a consumer located in the European Union, you have the right to withdraw from your purchase within 14 days of receiving the product, without giving any reason. To exercise this right, please notify us at customer@sensodelmare.com before the withdrawal period expires. We will refund all payments received, including standard delivery costs, within 14 days of receiving the returned product. Return shipping costs are borne by you unless the product is defective or incorrectly shipped.

Article 8 — Product Information We make every effort to ensure the accuracy of product information (descriptions, images, ingredient lists, etc.) displayed on the Service, but do not guarantee its completeness. Please note that the actual appearance of products may differ from what is displayed on screen depending on your device type and settings.

Article 9 — Personal Information Your personal information will be handled appropriately in accordance with our separately established Privacy Policy. By using the Service, you are deemed to have agreed to the Privacy Policy.

Article 10 — Intellectual Property All copyrights and other intellectual property rights in the content published on the Service (text, images, videos, designs, etc.) belong to us or the rightful rights holders. You may not reproduce, modify, republish, or distribute such content without our prior permission.

Article 11 — Disclaimer We bear no liability for any damages incurred by you due to natural disasters, system failures, communication failures, or other causes not attributable to us.

Article 12 — Measures for Violations If we determine that you have violated the prohibited activities in Article 3 or any other provision of these Terms, we may, without prior notice, take all or any of the following measures:

  1. Suspension of Service access
  2. Cancellation or rejection of orders
  3. Any other measures we deem necessary We bear no liability for any damages incurred by you as a result of measures taken under this Article.

Article 13 — Notices and Communications Notices and communications from us to you will be made by email or via replies to the inquiry form. Notices shall be deemed to have reached you at the time we send them to your registered email address.
